These General Terms and Conditions ("Terms") govern the use of the website kayastores.nl ("Kaya", "we", "us") and any purchase made through it. Kaya is operated by TynkTech VOF, registered in the Netherlands.

2. Applicability

These Terms apply to every offer, order, and agreement between Kaya and the customer. By placing an order you accept these Terms in full. We reserve the right to amend these Terms at any time; the version in effect at the time of your order applies.

3. Offers & Prices

All prices on our website are listed in Euros (€) and include VAT unless stated otherwise. We reserve the right to change prices at any time; the price at the time of your order confirmation applies. Obvious pricing errors do not bind us.

4. Orders & Agreement

An agreement is established the moment you receive an order confirmation by email. We reserve the right to refuse or cancel orders due to stock issues, suspected fraud, or pricing errors. You will be notified promptly in such cases.

5. Payment

We accept payment via iDEAL, credit card (Visa, MasterCard), Bancontact, and other methods offered at checkout. Payment is processed securely through Mollie Payments. Full payment is required before shipment unless otherwise agreed.

6. Delivery

Estimated delivery times are indicative and not binding. Standard delivery within the Netherlands is 2–7 business days. International delivery times vary by destination. Risk of the products transfers to you upon delivery. If delivery is delayed beyond 30 days without communication, you have the right to cancel the order for a full refund.

7. Right of Withdrawal (Herroepingsrecht)

In accordance with EU Directive 2011/83/EU and Dutch law (Wet Koop op Afstand), you have the right to cancel your order within 14 calendar days after receiving the product, without giving any reason. To exercise this right, contact us at info@kayastores.nl with your order number. You must return the product in its original condition and packaging within 14 days of notifying us. Return shipping costs are at the customer's expense unless the product is defective. Refunds are processed within 14 days of receiving the returned item.

8. Warranty & Complaints

All products carry the statutory warranty under Dutch law. If you receive a defective or incorrect product, contact us within a reasonable time. We will offer a replacement, repair, or refund at our discretion. Complaints can be submitted to info@kayastores.nl. We aim to respond within 5 business days.

9. Liability

Our liability is limited to the invoice amount of the product(s) in question. We are not liable for indirect, consequential, or special damages. Nothing in these Terms limits liability that cannot be excluded under Dutch law.

10. Intellectual Property

All content on kayastores.nl — including text, images, logos, and design — is the intellectual property of TynkTech VOF or its licensors and may not be reproduced without written permission.

11. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in the Netherlands. You may also use the European Online Dispute Resolution platform: https://ec.europa.eu/odr.
